It’s the Rule, by Terry Penza

 

It has been brought to our attention that some agents are advertising listings as "tear downs" without checking with the city to see if the home in fact can be torn down and what if any restrictions there may be on the property. It is the responsibility of the agent to obtain all ascertainable facts about a property. If the property is in a historical district or is an historical home there are limitations on tear down or even the type of remodeling that may be completed. In other instances the city may not allow another dwelling to be constructed on the land, or there maybe restrictions on the size of the dwelling.

 

Professional Assistants; Hiring and firing:

 

If you hire your own Professional Assistant rather than using a temp service you must adhere to a new set of guidelines. It is more than just a pay check that you must issue. There is FICA tax deposits, IL unemployment taxes, filing fees, etc. Another area that is just as important as taxes and filings is how to hire and fire.

 

You now need Performance Reviews where you discuss the employee's accomplishments and those behaviors that need improvement. Disciplinary Action must be in a uniform and progressive manner. The steps, arranged in order of their severity are:

 

1. Verbal Warning

2. Written Warning

3. Probation

4. Suspension

5. Discharge

 

Termination: State and Federal laws have a great impact on terminations, and they must be handled with expertise. If an incident occurs that you believe could be cause of immediate termination, contact your legal counsel. If the behavior is a repeated offense, the employee's file must be sufficiently documented to support the termination. Before you discharge an employee, review all documentation with your legal counsel.

 

Important reminders: All incidents of misbehavior, conversations with employees regarding those incidents, memoranda, employee responses, and other information pertinent to the misbehavior or performance problems must be documented in the personnel file. When you document violations or performance problems, be objective and give only the facts. Do not include your personal feelings or opinions about the employee or the incident in either the memorandum or your verbal warnings.

Fall is here and the leaves are turning which opens the door for the association to follow in kind. The merger with Barrington, creating the North Shore - Barrington Association of REALTORSÒ has been a positive move for both associations. Although there have been some technical difficulties with book rosters, updating the Barrington office and linking the computers at the two locations, we have begun to see success in such areas as participation in the Liaison committee, camaraderie at Board of Director's meetings and the much anticipated Holiday Party. We work well together and we have the right focus.

 

At the Installation, the MC, Ray Anderson, stated that "what it takes to get members involved is for the leaders to ask." Since it is difficult to speak to all 2,600 members directly, I am asking you, through this newsletter, to get involved. Come to the Holiday Party on December 8 and meet your peers. Attend the Mini convention January 29 (it will have an all new format) and have the opportunity to attend cutting edge education, see vendors who will provide you with needed services for the future, talk with your officers and directors and meet your peers. Volunteer for a committee and/or a task force. Attend special functions. Let us know if you are interested in becoming a leader. Our doors are open…talk to us!

Meet Ellen

 

Hi! My name is Elen Pizarro. You’ve probably heard my voice when you call the Northbrook office. I can asist you with ordering forms and supplies, photos and payment with credit cards. I have been with the Association for 2 months and prior to that I was a full-time mom to my 4 year old daughter. In my spare time I enjoy physical fitness, scuba diving (when possible), reading and spending time with my family.

Agents, newspapers and yard signs are keys to finding home ...

And the web? (Much ado about 2 percent)

The NAR has released its latest study of how homebuyers find the houses they want to live in, and despite all the publicity about the Internet and computer search tools- personal contact, yard signs and newspapers continue to be the most popular vehicles to homeownership.

In the survey, " The Home Buying and Selling Process: 1997", consumers were asked what sources they used when searching for a home. Their answers were:

 

82 percent used real estate agents;

51 percent used newspaper ads;

39 percent attended open houses;

38 percent looked for yard signs;

34 percent checked out homes magazines;

24 percent talked with friends and neighbors;

18 percent used on-line services and the Internet.

 

However, when asked where they first learned about the house they ultimately bought, the answers were:

 

50 percent through an agent;

17 percent from a yard sign;

9 percent from friends or neighbors;

8 percent from newspaper ads;

4 percent from open houses;

4 percent from the home seller;

3 percent from homes magazines;

3 percent from builders; and

2 percent from the Internet.

 

Even though the Internet still accounts for a small portion of real estate sales, the NAR said it is the fastest growing portion- increasing ninefold in the last two years.

 

According to the NAR survey, location continues to be the most important consideration in purchasing a home, but a variety of factors go into figuring out what the right "location" is.

 

The survey found:

 

79 percent said neighborhood was important;

73 percent said home price;

40 percent said proximity to work;

34 percent said proximity to schools;

23 percent said proximity to family or friends;

20 percent said proximity to recreation facilities.

 

The survey also showed the typical homebuyer searched a median of eight weeks to find the home ultimately purchased, and examined a median number of 10 homes. The typical seller's home was on the market for a median of seven weeks.

 

FSBOs accounted for about 15 percent of the homes sold, which the NAR said was consistent with past surveys.

 

Some 70 percent of buyers said they worked with only one agent. Of those who used an agent, 71 percent said they would use the same agent in the future.

TEMP

The status WITH has been changed to TEMP. All listings which had a status of WITH have been converted to TEMP. However, Prospecting and Saved Searches created to include WITH must be modified to include TEMP. Listings with TEMP status means they still have a valid listing agreement but have been taken out of the MLS system. You cannot solicit a TEMP listing.

 

Internet

MLSNI is currently testing listings on the Internet. Once the test has been complete the internet address will be given to all members. This is NOT for the public — to get into the Internet site you will have to input your password and ID number. Oh, just a reminder, giving out your ID and password to anyone is a major offense! Not only is it against the Code of Ethics and MLS Rules, but depending on the severity, MLSNI could press criminal charges. You should take this as very serious.

 

PC Access

Having trouble getting into the system at times with PC Access? At times the system changes two file names which them prohibit you from getting it. To check this, do not log on but hit "setup" on the main menu, then "Advanced" on the next menu, then "MLS Setup". The second box should have a file name that ends with MLSNI.scr and the third box file name should end with PCWIN.abm.

New Listing

Remember that if you have a new listing and there is a price change, you must call us to have the price changed. The listing will not be listed as NEW if you make the price change yourself.

 

Y2K

Still using Windows 3.1? Still have the Zenith computers we gave you in 1987? You have better plan your budget for 1999 for a new computer. They will not work 1-1-2000. There is a rumor that computer problems may start 9-9-99. Y2K Action Week was October 19-23 which was a part of the Clinton Administration’s effort to get the word out.

only Sen had a crystal ball.

 

Sen does hope you exercised your civic responsibility and voted. We can make a difference. REALTORS® just did. On October 8, NAR President Layne Morrill said, "Against all odds, this week, NAR scored one of its biggest lobbying victories in years. Both houses passed legislation raising FHA loan limits, which means 175,000 more families will become homeowners over the next 5 years. You helped to generate thousands of phone calls and letters to legislators. Many made face-to-face appeals."

 

He finishes "Thank you for your support and your action. You made the difference."

 

Last month I wrote that we hoped to bring you the good news that the Senate had passed an act giving copy right protection to MLS’s configuration of property listing data. Unfortunately a couple of minor changes are needed. It should pass in early 1999.

 

Congress has been in recess to allow members time to campaign. The many receptions, coffees, etc. spell opportunity for REALTORS® face-to-face meeting with legislators. Some are pictured here. No pictures, but a group of REALTORS® attended a diner where the main address was given by Speaker of the House Newt Gingrich.
