It’s the Rule, by Terry Penza

 

Question:  How should members conduct themselves when they are the selling side of a listing that was "no service".  As you know, there are real estate offices that offer a flat fee to owners and the only      service they provide is to place the listing in MLS --all appointments

                        and negotiations are thru the owner, not the listing agent.

                         

                        How is the proper way to proceed?  Shouldn't the selling

agent have the   seller sign a dual agency form?  How much can the selling agent do to   make sure the deal goes thru without taking on more liability?  Are     there other things they should be doing?

 

Answer:  The key for our members is to remember who it is they represent.  A buyer's agent must remember she owes duties to her buyer client only on the facts presented here.

 

First, on these facts, the seller is listed with another agent even

though he might be in a "no service" type of arrangement with that listing agent.  As a result, the License Law does not impose any disclosure duties on the buyer's agent.  The buyer's agent, by law, would represent the buyer only.  As a practical matter, if the seller should begin to ask questions of the buyer's agent that sound like questions more appropriately asked of the seller's own representative, the buyer's agent should remind the seller that she represents the buyer only and those questions should be directed to his own agent.  The important point to remember in this type of situation is that the buyer's agent represents the buyer only and should act accordingly throughout the process of negotiations and any resulting transaction.

 

To be certain the seller understands the buyer's agent's position, a buyer's agent might even give the seller a Notice of Designated Agency or some other written notice that tells the seller she is not his agent. Since the seller has previously signed with a listing agent, dual agency should not arise.  Consequently, the buyer's agent should be careful not to act like a dual agent in these situations.

seems like just yesterday when I was installed as Chairman of the Board of the North Shore—Barrington Association of REALTORS® and now my “days are numbered”. 

 

It has been a memorable year with the merger of North Shore and Barrington.  It has been an honor to be a part of the new and exciting association.  I’m looking forward to seeing all of you Thursday, September 30 when I will have a chance to thank you personally for the chance to serve you.  The Awards and Networking session is one of the few times we get together as a group.  I’m sure you will want this chance to Network with “old” friends and meet new colleagues.

 

Our web page continues to grow and with the addition of a new Technology person, Jason, we expect more member enhanced changes.  200 members have signed up for the list serve.  A type of chat room but instead of live chat, a person sends an email that automatically goes to all 200 and if anyone responds, it also goes to the 200.  Our goal is to have more members embrace the opportunity to discuss real estate issues.  Think of this as the electronic networking system.

This is my last article in the REALTOR® News and I could not end without taking the time to say Thank you!  It has been an honor and a pleasure!

NSBAR, MLSNI, MAP, IAR, etc. You are a member of NSBAR which stands for the North Shore - Barrington Association of REALTORS® and through that membership you are also with IAR, the Illinois Association of REALTORS® and NAR, the National Association of REALTORS®. Your MLS is through MLSNI. NSBAR along with 11 other REALTOR® associations in the Chicago area are shareholders of that MLS. MAP is also a MLS and even though most of the members happen to be REALTORS®, they are NOT affiliated with a REALTOR® association. REALTOR is a federally registered mark owned by the NAR. Only members can use the term REALTOR®. REALTOR® is NOT synonymous  with broker.

 

 

 

What floor is it on?

 

As you know with a property type two, the level next to the room dimensions is not the level of the unit but whether it is the first floor on that particular unit. UFL, Unit Floor Level is where you indicate the level the unit is found. On the input sheet, UFL, a required field, is just above the Monthly assessment.

 

PMI

 

The law providing for cancellation of private mortgage insurance takes effect July 29. Homebuyers who take

out loans after that date can request PMI cancellation once their equity reaches 20 percent. Cancellation is automatic once their equity reaches 22 percent. For complete info, GO TO: One Realtor Place, search PMI cancellation.

Back To School…A Quick Update

With fall just around the corner and broker license renewal quickly approaching, we have a complete curriculum of new coursework available for you.  Take some time out to browse through our Continuing Education Catalog.  We have classes in Northbrook and at the Barrington Library.  We are also currently offering Broker Pre-Licensing Classes.   It’s not too late to register for some of the courses…remember, after the end of this year, those of you interested in obtaining a broker’s license will be held to the new License Law. The ABR Modules are being offered this Fall…October 21 & 22.  And we are busy planning our 12th Annual Mini-Convention.  Our mini-convention will be at the Northbrook Hilton on January 20, 2000!!

The Impact Of Y2K

What is the Year 2000 (Y2K) problem?

 

The Year 2000 problem occurs because some computer programs and equipment, especially older ones, might fail when the date changes to 2000. Because the programs and equipment were written to recognize only the last two digits of a year, such programs could read the digits “00” as 1900 instead of 2000.

 

What will the Year 2000 (Y2K) problem affect?

 

Y2K will affect equipment that includes the following older equipment:

 

·         PCs

 

·         Printers

 

·         FAX Machines

 

·         Telephone Systems

 

Y2K will affect most programs, which includes the following:

 

·         Accounting programs

 

·         Spreadsheets

 

·         Operating Systems (Windows 3.1, Windows ’95 and some versions of Windows ’98)

 

What does this mean to me?

 

You will need to check with your vendors regarding PCs, Printers, and FAX Machines, Telephone Systems, Operating systems like Windows 3.1, Windows ’95 and certain versions of Windows ’98.

 

Special note, according to Microsoft the DOS operating system is not Y2K compliant and will not operate in the Year 2000. Your only option is to upgrade and move off of that older operating system.

 

How do I know if I am Y2K compliant?

 

You can contact the appropriate vendors, we suggest using the Internet and follow the procedures those vendors outline on their Web Sites.

PCI Hardware Modems

Modems are a very important piece of equipment and as REALTORS® we need excellent modems.  They must have UART (Universal Asychronis Received Transmit) chips, without these chips data from your computer must be processed by the CPU or Pentium chip in your computer. This will not handle the MLS software properly. 

 

For the past year or so, good modems have been tough to come by.  The cheap "winmodems" will work on the Internet (32 bit programs) but not on the MLS.  A part of the problem is that modems will be obsolete in a couple of years.  Cable modems and DSL will replace them.  Both of these services offer much faster and more reliable data delivery over lines that are in you house now.  Since there's no future in modems, companies like 3com (formerly US Robotics) have decided not to spend money on modem development.  What to do…

 

I hope that modems made with Lucent Technology chips that are "controller-based" (that's the UART chip) and designed to go into new computers PCI slots will fill the bill.  As of this writing, Gateway sent one of these new Lucent modems to an office and it has worked very well for a little over a week.  The modem is made by a company called ActionTec.  I've never heard of them before, but Lucent is certainly reputable (formerly AT&T Technology) and the modem I've seen from Gateway is doing the job.  When I find out where you can purchase an ActionTec modem I'll let every one know.

 

Microsoft Office 2000 requirements

These stats are right off the Microsoft web site.  This has to do with the amount of RAM needed to run Office 2000 programs.

 

Windows 95 or

Windows 98

16 MB of RAM is required for the operating system, plus an additional 4 MB of RAM for each program running simultaneously, except the following as noted:

8 MB Microsoft Access
8 MB Microsoft FrontPage
8 MB Microsoft Outlook
16 MB PhotoDraw

What this means is that from here on out you better count on having 64 mb of RAM as a bare minimum to run windows and other programs.

 

Oct. 1 MLS Xplorer is free

That's right, as of October 1 this year, agents can access the MLS via the internet using nothing but their browser.  That is with Netscape or Microsoft Explorer you can get into the MLS and all the listings and comps with any browser using the internet.

Before Oct. 1 the price is $75.00 per year.  If you buy it on September 30 you still pay $75.00 and won't get a refund.

The look of MLS Explorer is totally windows and completely different from PC Access and Landmark.  It takes some getting used to.  This is the future of the MLS.  A year from now, the MLS will be ONLY ON THE INTERNET.

 

Agent Web Pages for Sale

The North Shore-Barrington Assoc. of REALTORS® has entered into  a deal with Internet Crusade to help create simple effective Home pages for our members.

The cost is $799.00 year one and $249.00 per year there after.

Pages can be changed at anytime by the agent with simple software supplied by Internet Crusade.  Call the board for more info.

 

Regular Maintenance is a must for smooth PC Sailing

In July at the board we got a serious dose of computer virus fever.  After months of ignoring an increasing problem with Word files that sporadically showed up with colorful geometric shapes we discovered a virus in our network system.  Being on the network meant that anyone who opened a file off the network was contaminated.  I, computer boy, was convinced that we had NO viruses because I was dutifully updating my virus program off the Internet and scanning suspect files.  The files came up clean.  Then by chance a visiting techy updated one of our virus programs with a file just a couple of weeks newer and voila, we had mucho viruses.  What disturbed me was that I was updating just the virus definition files and NOT the actual virus program.  That is supposed to work.  But it proved that you have to buy the whole darn program maybe once a year.  These viruses are getting so picky that you can't be too careful. 

 

Virus 101

After last months debacle at the board with viruses I thought I should emphasize to members that there are lots of virus' that don't do much damage and are easy to spread.  There are lots of the Microsoft Word "macro virus" other than the infamous Melissa Virus. 

The problem is that MS Word has become the defacto standard for word processing in the US.  So the cretins that write macro viruses write them for MS Word.  Melissa was a Word macro virus.  That's why WordPerfect users and Macintosh users weren't affected.  Anytime you get an email with an attached Word file you should scan with an up-to-date virus program.  Anyone who gives you a floppy disk with a word file on it should also be scanned for viruses.  You must keep your virus program up-to-date and that means you need Internet access.

The virus programs to buy are Norton Anti-virus or Mcafee Anti-virus.

 

Internet Scams

As more of us use the Internet, and I now think most REALTORS® agree that the Internet and Email are necessary business tools.   The threat of Viruses, fraud and scams become more of a problem.   I constantly receive warnings of credit card scams.  AOL warns all it's users that NOBODY on staff at AOL will ever ask for your user name or password.  This advice applies to all ISP's. 

My service, AT&T, recently uncovered a credit card scam in which criminals, email users and state that "due to a security problem, you must re-submit your credit card numbers" to avoid losing their Internet accounts.   Never give your credit card or ID and passwords to any UNSOLICITED requests. 

Terry and I buy dozens of things off the Internet with our credit cards but we always initiate it, such as purchasing a book online.  Neither Terry nor I or thousands of others have had any problem when dealing online with a reputable web site.  But nobody ever asks us for credit info without our initiating the transaction.
