Managing Multiple
Purchase Offers
The following is a response from the National Association of REALTORS®
in respect to NAR guidelines regarding managing multiple purchase offers:
In response to your inquiry, this
is to advise that the Code of Ethics neither requires nor does it prohibit
“shopping” of offers to induce other buyers to make higher offers.
The Interpretations and
Procedures Subcommittee of the NAR Professional Standards Committee have
discussed this question of “shopping” offers.
The general consensus reached (though not reflected, at least to date,
in the Code) was that simply telling a cooperating broker or a potential
purchaser that another offer is on the table or is anticipated is not unfair to
the first offeror; nor is there any obligation to tell the first offeror that
the existence of his or her offer (or the fact that an offer is anticipated)
has been shared with another potential purchaser or with a cooperating
broker. In the same light, though,
there is no duty under the Code requiring listing brokers to advise potential
purchasers that other offers exist or that other offers are expected. The question of whether a listing broker
could not only divulge the existence of one buyer’s offer to another buyer, but
also the price offered, has not been addressed.
Some have contended that in
multiple offer situations every offeror should be advised of the existence of
other offers and given the opportunity to reconsider and perhaps increase their
offer. For example, if the existence of
Buyer A’s offer is divulged to Buyer B, then Buyer A should be apprised of that
disclosure and be given the opportunity to better his offer and then, if Buyer
A does not increase his offer, then Buyer B should be afforded the same
privilege. Constructively, this creates
an auction, which is not something ordinarily called for in terms of a listing
contract or required under the Code. In
other instances listing brokers have taken things a step further and, in
multiple offer situations, counseled clients not to accept any offer and
instead to advise all buyers that multiple offers existed and to give each
buyer the chance to increase their offer.
The drawback is, of course, that all of the buyers may withdraw their
offers and pursue other properties.
This, too, is not required under the Code.
The key seems to be
reasonableness. For example, while the
Code requires absolute fidelity to the client’s interests, it would seem
unreasonable to expect that listing brokers would devote all of their time and
effort to advancing the interests of one client to the exclusion of
others. It would seem the same test
would apply to the efforts that must be made in securing offers for clients to
consider.

Roxane
Malo’s exposure to the business world came at a young age by way of the
family’s automobile franchise. Through
summer vacations and a high school internship program, she was able to learn
the different facets of the automobile industry. Roxane continued to work in the family business while attending
Mundelein College in Chicago, where she received a Bachelor’s Degree in both
Business Management and Theater.
Roxane
was a woman before her time in a male dominated business which tended to
prohibit her ownership of an automobile franchise herself. She then focused her attention in the field
of real estate by attending a real estate education program and becoming a
licensed REALTOR®. Though
very young, she pursued in this challenging career and became the top producer
at Quinlan & Tyson in Glenview. In
1987, after 12 years in real estate, Roxane became one of the founding partners
of Village Green Realty in Winnetka, where she has enjoyed the benefits and
rewards of a very successful team of partners and associates.
During
her real estate career, Roxane has served as a director of the North Shore
Board as well as Secretary/Treasurer.
She has also served in the capacity of a Director of the Illinois
Association of REALTORS® and Chairman Elect for the newly formed
North Shore - Barrington Association.
She has donated unlimited efforts on NSBAR committees for Professional
Standards, Mini-Convention, and Finance and at the state level has served on
legislative and finance committees. Her
most recent appointments include the Association Operations Member Involvement
Group and the Professional Standards Committee for the Illinois Association of
REALTORS®.
With her husband,
Tom, and her 15 year old twins, Shannon and Erich, Roxane currently resides in
Northfield. Her son and daughter are
sophomores at New Trier High School.

News Release from the Illinois Office of Banks and Real Estate
Chicago--Real Estate
Broker license was revoked for failing to account for escrow funds and failing
to remit the earnest money back to the buyer upon written direction of all
principals to the failed transaction.
Chicago--Real Estate
Broker license was reprimanded and a $500 fine was assessed for failing to
timely renew her Real Estate Broker license.
As a consequence of this failure to timely renew, the branch office of
____ was without a managing broker for over four months. Furthermore, several Salespersons sponsored
under her license were practicing real estate during that period without a
properly-licensed Sponsoring Broker.
Chicago--Real Estate
Salesperson license was placed on probation of two years and a $500 fine was
assessed for negotiating directly with a Seller without authorization from the
Seller’s exclusive listing agent; for failing to disclose her licensee status
on the face of a contract in which she was the Buyer; for failing to fully
complete a form contract before it was signed; and for failing to deposit
$5,000 escrow money with her Managing Broker as per terms of a sales contract.
Des Plaines--Real Estate
Salesperson license was reprimanded and a $500 fine was assessed for falsely
indicating on her 1997 renewal form that she had completed sufficient
Continuing Education during the 4/1/95 to 3/31/97 pre-renewal period.
Grayslake---Real Estate Broker license was suspended
for six months, and an exemption from continuing education was forfeited, for
making false promises and misrepresentations, failing to maintain proper escrow
records, failing to produce escrow records to OBRE within thirty days of a
request, and failing to account for all escrow monies.
Springfield--Real Estate Salesperson license was
placed on probation for a period of one year for improperly handling an escrow
check, materially altering a contract, and exceeding his authority by giving an
interpretation of a contract.
The law providing
for cancellation of private mortgage insurance takes effect July 29, 1999. Homebuyers who take out loans after that
date can request PMI cancellation once their equity reaches 20%. Cancellation is automatic once their equity

REALTORS, the law regulating underground storage tanks has not changed. Section 2(2)(a) of the Gasoline Storage Act
prohibits local governments from adopting any ordinance that is not identical

I had the good fortune
to witness humanitarian work first hand today.
I attended open houses for the two buildings that Eve Beverly and her
sister, Dedra DeSavieu, rehabilitated at 5627 and 5532 South Indiana. As Eve says, "They are change agents in
the neighborhood." It is a great
neighborhood, with good transportation, near the Dan Ryan, near Hyde Park, the
University of Chicago, and the Museum of Science and Industry. I really admire people like Eve and Dedra
who have the courage to put their talent and money where their mouths are. They sustained multiple break-ins, with
claw-footed tubs and radiators stolen.
They also have a unit that is handicapped accessible.
We certainly gave
our Humanitarian Award to the right people and can be proud of our selection.
Thought the members
of NSBAR should know that the recognition that we gave Eve and Dedra was very
well deserved.

I have more issues
with agents not providing lot size dimensions and no apparent fines being
incurred. Additionally, I do a certain
amount of business with the disabled.
There is very little on the input form that provides me information re:
accessibility of the building and its garage.
I can never ask an agent to determine accessibility of a certain home as
that is dependant upon a particular buyer’s chair. But if there was a way to save me 30-40 phone calls, I would
truly appreciate it. Elevators do not
mean a building is accessible! It
amazes me how many developers have gotten around the codes. The first development I have found to be
compliant is Gallery 400 on West Ontario.
Single family home info on accessibility is non-existent. I often get to a home and there are stairs
from the front and/or a garage that
does not allow me to show the home.
Agents need to understand that even one or two steps can be an
obstacle. Needless to say, I always
call ahead, but it would be far more productive if the MLS input form would
provide some sort of field. The current
one is inadequate.

It’s beyond arguing
now that you have to use today’s technology to capture market share in our
industry. The question now is, “Where
do I start?” Here are a few suggestions
designed to maximize your effectiveness in using today’s technology.
Hire An Assistant Who
Knows Technology
An assistant who knows technology and
who takes care of your technology needs frees you up to do what you do best:
meet people and cultivate business.
It’s as simple as that. If you have 25 or more transactions and don’t
have a personal assistant, you’re tied up doing the "little things"
instead of generating business. If you currently have an assistant, but he or
she doesn’t know and use technology, you’re severely handicapped.
Hire A “Techie”
If you have a personal assistant who knows technology, terrific; if you don’t, then hire a “techie,” someone to whom you can turn over all your technical needs. You get the money-making concepts, the techie carries them out for you. The simplest way to hire someone who can take over all your technology for you is to call your local high school and ask the computer science instructor to recommend a student who knows technology. He or she will be able to do everything for you. If you get a digital camera, for example, give it to the techie for a week, then have him or her show you how to use it. The same holds true if you want to learn a real estate database, start using multimedia in your presentations, or any other technical task. Remember: you’re the CEO of your company, charged with its growth: hire someone to implement your technology!

Win Modems NO, NO, NO !
LT Modems NO, NO, NO !
I don't know how to say this any other
way. The regular modems that ALL computer makers ship in their PC's are one of
the above. They don't work for us… period. If your computer is freezing
or disconnecting while on the MLS either searching or printing you have a modem
problem. We can try and help you but it won't be a good fix. Realtors need for
the MLS, a hardware based or controller based modem.
Nobody is making these anymore except for some external modems. The only modem
I know of that is worth a darn is made by a company called Actiontec. See them
at www.actiontec.com on the web.
To check your modem, right click
on My Computer, then click on Properties, then click on Device Manager, then
double click on Modems. Read the modem
that appears, if it says win modem or LT modem you've got the lousy modem. We
can try and help your setup on the phone. If that doesn't work, you can buy an
external modem: 3com 56k fax/data modem.
I mentioned last month that
Gateway shipped several modems made by Actiontec to one of our member offices.
All MLS problems were solved. However, getting anyone at Gateway that knows
what you mean by asking for an Actiontec modem is near impossible. Dell has a
partnership with Actiontec for modems but we can't find anyone in sales at Dell
that knows what we're talking about either. I wish I had an answer. We, REALTORS® are in a small minority of
users that need the special modems and so nobody at any PC companies knows what
we're asking for. It may get better sometime next year. (See next paragraph)
PCI Hardware Modems
Modems are a problem. We, as
REALTORS®, need real ones that are hardware based. Meaning that there ARE
certain chips on the modem. If the chips are left off, the modem is software
based. These chips are UART chips. (Universal Asychronis Receive Transmit)
Without these chips on the modem the handling of incoming and outgoing data
from you computer must be done by the CPU or Pentium chip in your computer.
This is a cheap way to do it and thus the "God of Least Cost" wins
again. Also, software modems rely on pure Windows 32 bit programs to work. All
our MLS software: Viewpoint, Landmark and even PC Access are 16 bit programs.
If you look at PC Access the face is a windows program but underneath, it looks
and acts just like good old Viewpoint and it is in fact a DOS based 16 bit
program. This is why the board is so adamant about getting a good hardware
based modem.
For the past year or so, real
modems have been tough to come by. The cheap "win modems" work on the
Internet (32 bit programs) but not on the MLS.
Part of the problem is that
modems will be gone in couple of years. Cable modems and DSL will replace them.
Both of these services offer much faster and more reliable data delivery over
lines all ready in your house. Since there's NO future in modems, companies
like 3com (formerly US Robotics) have decided to not spend another nickel on
modem development. What to do…
I have hope that modems made with
Lucent Technology chips that are "controller-based" (that's the UART
chip) and designed to go into new computers PCI slots will fill the bill. As of
this writing, Gateway sent one of these new Lucent modems to an office and it
has worked very well for a little over a week. The modem is made by a company
called ActionTec. I've never heard of them before, but Lucent is certainly
reputable (formerly AT&T technology) and the modem I've seen from Gateway
is doing the job. When I find out where you can purchase an ActionTec modem
I'll let every one know.
Chicago Neighborhood Numbers
for MLS Searches
The Chicago Tribune has put on
it's web site a nice map with all the official neighborhoods of the city. These
are the official neighborhoods as used by the census bureau and MLSNI. So if
you're looking in Chicago and don't know the neighborhood to look in on the
MLS, then point your browser to www.chicagotribune.com and go to the
classified, homes, transactions page and click on the 77 community names link.
Microsoft Office 2000
Requirements
These stats are right off the
Microsoft web site. This has to do with the amount of RAM needed to run Office
2000 programs.
Windows 95 or Windows 98
16 MB of RAM is required for the
operating system, plus an additional 4 MB of RAM for each program running
simultaneously, except the following as noted:
8 MB Microsoft Access
8 MB Microsoft FrontPage
8 MB Microsoft Outlook
16 MB PhotoDraw
What this means is that from here
on out you better count on having 64 mb of RAM as a bare minimum to run windows
and other programs.
Oct. 1, 1999 MLS Xplorer is
Free
That's right, as of October 1
this year, agents can access the MLS via the internet using nothing but their
browser. That is with Netscape or Microsoft Explorer you can get into the MLS
and all the listings and comps with any browser using the Internet. AOL can
access Xplorer.
The look of MLS Xplorer is
totally windows and completely different from PC Access and Landmark. It takes
some getting used to. This is the future of the MLS. A year from now, the MLS
will be ONLY ON THE INTERNET.

You are not stupid; I know that it
is hard to believe. When I talk to agents on the phone for computer help they
always start with, “I’m stupid!” followed by, “Can you help? What did I do?
This stupid machine!” and “They shouldn’t let so n’ so use the office machines
anymore!” (which is my personal favorite!)
Computers are a wonderful way to
work, express yourself, educate yourself, and to look up that guy who still
owes you $20 from college. But I
digress, I like to think that the real estate agents who call, are educated,
rational beings capable of just about anything. But we know better: the Computer is the true leader of the office
gods, rationing out sanity as it sees fit. In certain offices there are rituals
of how to treat the computers so you will not anger them, and even the fax
machine (which is a much more cruel god) has begun to lose its status to these
easily upset over emotional pieces of hardware. If you are familiar with these
problems I will offer a solution:
1. Relax. The computer does not know you from anyone
else.
2. Even though it seems
like it, the computer does not intentionally work for everyone but you.
3. You do not have to
know how to program a VCR to use your computer
(because, as everyone knows, the VCR is the trickiest of creatures that only
befriends children and the elusive remote control now and again.)
4. You can always call
for help...whether you use the phone or not is up to you.
5. See the computer as a
tool, like a hammer.
6. If your machine
refuses to work, see your machine with a hammer.
(NSBAR does not recommend this
form of repair at any time.)
